FELONY CLASSIFICATIONS


Felony offenses are divided up into the following classifications:

A capital felony is punishable for life in prison or the death penalty. If the State does not seek the death penalty, upon conviction, an automatic life sentence is imposed. Where the State seeks the death penalty, upon conviction, the jury must answer questions which may result in either a sentence of life imprisonment or a death sentence.

A First Degree Felony is punishable for not less than five years and not more than 99 years or life in prison and an optional fine not to exceed $10,000.

A Second Degree Felony is punishable for not less than two years and not more than twenty years in prison and an optional fine not to exceed $10,000.

A Third Degree Felony is punishable for not less than two years and not more than ten years in prison and an optional fine not to exceed $10,000. A State Jail Felony Offense is punishable for not less than 180 days and not more than 2 years in the state jail and an optional fine not to exceed $10,000.
